The case will be heard tomorrow when the date on which the supplementary affidavits will be filed would be decided.
Kereke, who is facing charges of raping an 11 year old relative, was represented by Advocate Lewis Uriri who was instructed by James Makiya.
Today, Justice Happias Zhou was supposed to determine whether Kereke should answer to the rape charges.
The development came after the girl’s guardian, Francis Maramwidze, filed an application with the High Court seeking an order calling for Kereke’s prosecution.
The application cited police Commissioner General, Augustine Chihuri, the Attorney General, Johannes Tomana and Kereke as first, second and third respondents respectively.
This month, Kereke approached the Constitutional Court, arguing he should not be cited as a respondent in Maramwidze’s application.
In his application, Maramwidze claimed that after he reported the rape case to the police, Kereke threatened to sue him and this prompted him to make another report pertaining to the threats.
He said the police told him to be careful as Kereke had the support of the Criminal investigations Department and other influential individuals, a development he said made him lose confidence in the justice delivery system.
Kereke however denies the allegations saying he cannot influence police decisions on criminal matters.
