ZLHR to sue cops over roadblock accident

Police have denied responsibility for the injury of four passengers in April when a kombi they were travelling in overturned at a roadblock along Khami Road.

The Zimbabwe Lawyers for Human Rights (ZLHR) on petitioned the police to compensate the accident victims and foot their medical bills or face a lawsuit. Chief Superintendent W. Marecha from the police legal service department wrote a letter to ZLHR denying responsibility for the accident.

“It is materially incorrect to hold that police officers threw spikes in front of the oncoming vehicle. The spikes were laid earlier on commencement of duty. Any pending lawsuit should be filed vicariously against owner of the public service vehicle, Erick Chidemo, for putting lives of innocent commuting public in danger by allowing an unde- aged driver to drive a public service vehicle ,” reads part of the letter.

Lizwe Jamela of ZLHR, who is representing the four, said “Now that the police have communicated their position to us, we will file a lawsuit for damages. We are adamant that the police were responsible for this accident. This issue can now only be settled by the courts.”

The driver of the kombi, Nqobile Moyo, 23, is currently on remand for reckless driving, operating off-route and driving without a defensive driving certificate. He is out of custody on free bail.
