Matombo, Chimanikire saga deepens

HARARE
The protracted war between trade unionists Gift Chimanikire and Lovemore Matombo over a motor vehicle has taken a new twist, with the former threatening to expose his ex'boss if he continues acting in bad faith.
Chimanikire is the MDC (Tsvangirai) MP for Mbare, while Matombo is the Pre

sident of the Zimbabwe Congress of Trade Union (ZCTU).
The duo’s feud started about two years ago when Matombo through his lawyer, Tendai Biti of Honey and Blanckenberg Legal Practitioners, filed a High Court application requesting Chimanikire to return the 4×4 vehicle allegedly belonging to Communication and Allied Services Workers Union of Zimbabwe (CASWUZ).
In his founding affidavit Case No. HC6016/05 dated 18 November 2005; Matombo said the Chimanikire was unlawfully in possession of the car as he had formally tendered his resignation as General Secretary of CASWUZ in 2005.
But the tough’talking Chimanikire told The Zimbabwean last week that he would not surrender the car and challenged the status of Matombo as the president of the Union since he is no longer employed by Zimpost.
He said in terms of the CASWUZ Constitution he (Matombo) continues to hold the post unconstitutionally and therefore that invalidates the application affidavit, as he can’t legally claim to represent the Union.
Chimanikire blasted Matombo for lying under oath that he deserted his post in 2003 instead of 2005.
Biti, through his letter dated August 2005, confirmed the feud between the two and proposed an out of court settlement. “It will be a sad day indeed in which the two of you were to fight over a simple thing such as a motor’vehicle,” he said. ‘ Chakanza Paranji
