Pius Ncube to drag alleged husband over adulterous claim (14-08-07)

LAWYERS representing Archbishop Pius Ncube say they will drag to the High Court a Bulawayo man who claims the government-arch critic was in an adulterous relationship with his wife in a bid to force him to reveal the source of his alleged claims.

ews on Tuesday (today), Nicholas Mathonsi of Coghlan and Welsh Legal Practitioners, said that they would be left with no option but to drag Sibanda to the High Court to reveal the source of his adultery claims for him to plead.

“We are entitled to that information and all will depend on their response this time but if they keep ignoring our request, we will be left with no option but to drag Onesmus Sibanda to the High Court to force him to reveal the source of his claims and other required details to enable us to plead,” said Mathonsi.

Mathonsi is demanding that Sibanda furnish him with details of the alleged adultery claims between Archbishop Ncube and Rosemary Sibanda “including the dates, times and venues of the alleged acts of adultery as well as the details of those who witnessed the alleged threats” or face being dragged to the High Court.

A similar demand was made in his first request last month but Sibanda through his lawyer, Munyaradzi Nzarayapenga of Dube-Banda, Nzarayapenga and Partners did not accede to the demands claiming that this aspect ‘would be amplified by his evidence at trial.’

Sibanda had in his earlier response to the same request indicated that these particulars were not necessary for purposes of pleading as opposed to trial and declined to give any details.

In his latest request Mathonsi in court papers said: “It is the plaintiff (Mr Sibanda) who is seeking damages for alleged acts of adultery and for that reason he must supply particulars of the alleged adultery including the dates, times and venues of the alleged acts of adultery as well as the details of those who witnessed the alleged acts.

“The Plaintiff has alleged that the Defendant engaged in an adulterous relationship well knowing of the marital status of the Plaintiff’s wife. He is therefore obliged to supply the particulars and the Defendant demands those particulars as he is entitled to them in law.”

Archbishop Ncube has been in the news since July 16 when Mr Sibanda filed a $20 billion lawsuit against him at the High Court in Bulawayo last week, accusing him of having an adulterous relationship with his wife. Mrs Sibanda has publicly confessed to having an affair with the archbishop, an avowed critic of the Government- CAJ News.
