Court frees 65 MDC activists detained under  POSA

MUTARE - A Mutare magistrate on Monday set free 65 opposition MDC activists arrested under the repressive Public Order and Security Act, POSA for illegally demonstrating against the beating of MDC leader Morgan Tsvangirai last March.


Magistrate Chipo Mapfeka removed the 65 from remand on the grounds of lack of evidence saying the state would proceed by way summons on the group if it finds any new incriminating evidence against them.
The state represented by Mavis Saurombe concurred with the ruling.
The 65 who were represented by attorneys David Tandire of Henning Lock Donagher and Winter and Innocent Gonese of Gonese and Ndlovu legal practitioners, were pleading not guilty.
The state was accusing the 65 of illegally demonstrating in the central business district disturbing the peace of the city. The group has been on remand since March and their lawyers successfully applied for their removal from remand hearings for lack of
 evidence.
MDC provincial spokesperson Pishai Muchauraya said he was happy the court had removed the party’s members from further remand hearings.
“As a party this is great as the police arrested them for no reason. We are quite happy with the decision of the court.”-CAJ News.
