High court rejects MDC bid to seek ZEC announce withheld presidential polls


HARARE, Zimbabwe, (CAJ News)--THE opposition Movement for Democratic Change (MDC) has lost a bid to force the Zimbabwe Electoral Commission (ZEC) to announce the outcome of the March 29, 2008 presidential election.

 

Justice Tendai Uchena threw out the application with costs in his judgment he handed down at the High Court on Monday afternoon (today).

 

MDC leader, Morgan Tsvangirai claims that he won the presidential ballot by about 50,3 percent and has been waiting for more than two weeks to have ZEC confirm the outcome put forward by his party.

 

President Robert Mugabe has however remained mum on the result, with party officials saying that the ruling party was gearing itself for a re-run of the election as none of the four contesting candidates had attained the requisite 51 percent.

 

In his judgment, Uchena said that he would forward the reasons for his judgment to the Registrar General, Tobaiwa Mudede’s office.

 

The judgment comes amid revelations that the Zimbabwe Electoral Commission was expected to proceed with a recounting process for about 24 constituencies in which Zanu-PF had challenged the results.

 

Several ZEC officials have been arraigned before the courts to face charges of misrepresenting election results as alleged by Zanu-PF—CAJ News.
