Judge throws out Mukoko application

HARARE- High Court Judge Alfias Chitakunye on Wednesday rejected an application by incarcerated director of the Zimbabwe Peace Project Jestina Mukoko saying she had not followed proper court procedures.

His decision could further strain the process of an inclusive
government as Morgan Tsvangirai, leader of the larger Movement for
Democratic Change (MDC

T) has since reitarated he would joing a unity pact unless Mukoko and others were released.

Mukoko’s
lawyer Harrison Nkomo said Chitakunye said the accused needed top go
back to the magistrates court and have charges against her properly
read out.

"I was puzzled by the decision but it has left me with no
choice but to seek leave of appeal directly to the Supreme Court after
the judge dismissed my application to seek to that Higher Court," Nkomo
said.

The former Zimbabwe Broadcasting Corporation news reader was
abducted on December 3 and tortured by members of the Central
Intelligence Organisation

(CIO) for 19 days to admit to charges of banditry.

Mukoko,
currently being held at Chikurubi Maximum Prison, stands accused
together with seven MDC-T activists of training insurgents in Botswana
to topple President Robert Mugabe from power through uncouth means.

The charges have since been denied by Zimbabwe’s neighbour, Botswana and the accused persons.
