The charges arose from a demonstration which took place on the 11th of November 2008 which was organized by the National Constitutional Assembly (NCA), demanding a new constitution just before the formalization of the Government of National Unity (GNU).
The five students who had appeared in court on Wednesday 20th of May 2009 when the state and the defense counsel gave their final submissions and judgment was reserved for the 27 of May. The prosecutor argued that students violated the Public Order and Security Act (POSA) intentionally and as such should face the consequences of their actions. The students were represented by Ms Nqobile Ndlovu from the Zimbabwe Lawyers for Human Rights (ZLHR).
Yesterday the magistrate failed to turn up so as to hand over judgment on the case. The prosecutor had to postpone the judgment to 10 June.
