Watchdog commissions

The members to this Commission are also appointed by the President in consultation with the Committee on Standing Rules and Orders.

The main functions of the Anti-Corruption Commission are combating corruption, theft, misappropriation, abuse of power and other improper conduct. It also makes recommendations to government and other organisations in the private sector on measures to ensure that peoples conduct is above board and they are answerable for their actions. The Commission has powers to conduct its own investigations upon receipt of complaints and enlist assistance from the police and the Attorney Generals office to prosecute cases of corruption.

Zimbabwe human rights commission

This Commission is not yet in place. The Chairperson of the Commission is to be appointed by the President after consultation with the Judicial Service Commission and the Committee on Standing Rules and Orders. The other members will be appointed by the President from a list submitted by the same Committee. Its functions shall be to promote awareness of and respect for human rights and to develop human rights and freedoms. It will also monitor and assesses observance of human rights and investigate human rights violations. It will assist in the preparation of regional and international human rights reports. With an enabling Act of Parliament its functions can include inspection of prisons, places of detention and places where mentally handicapped people are kept. It can also secure appropriate redress for victims of human rights violations if such an enabling Act is in place.

Issues of concern

How can the Constitution ensure that these watchdog Commissions adhere to the rule of law and remain non partisan and professional?

Effective operation of these Commissions depends on availability of resources. Should the Constitution provide for an allocation of a specific percentage of the national budget for their operations?

Notwithstanding the input from the Committee on Standing Rules and Orders, should the Constitution provide additional mechanisms to ensure wider consultation concerning recruitment of Commissioners to serve on these Commissions?
