Workers in court over diamonds

MUTARE Two South African citizens and employees of Canadile Investments mining company last Friday appeared before Mutare magistrate Lucy Mungwari charged of unlawful dealing in and possession of precious stones valued at about US$28 000.

The police at a check point at Hotsprings 80km south west of Mutare arrested the two, Komilan Packirisamy, 37 and Viyandrakumar Naidoo aged 46, after 57 pieces of diamonds were allegedly found on Packirisamys, trousers pockets. The two, first appeared in court on February 2 and were remanded to Friday February 5 for trial after posting US$2 700 bail each.

Mungwari remanded only Packirisamy to February 28 for continuation of trial after both defence lawyers and the state consented that the accuseds lawyers had been served with the dockets late.

Naidoo was removed from remand after his lawyers, Victor Mazengero and Misheck Mugadza successfully submitted to the court that the diamonds were not recovered from him, but from Packirisamy. Michael Mugabe representing the state conceded that the docket had been served late to the defence lawyers and that the state had no case against Naidoo, and that it would be difficult to prove that he had acted in common purpose with the accused. It would only take a miracle doing so to prove a case against him as he had no physical possession of the diamonds, said Mugabe to the relief of Naidoo.

The state is alleging that police received information that Pickirisamy was stealing diamonds from Canadile Mine in Chiadzwa where he is employed. The state further alleges following the information a police road block was mounted at Hotsprings where the accused was arrested when the 57 pieces of precious stones were recovered on him.
