Bishop appeals against ruling

HARARE Former Anglican bishop Elson Madoda Jakazi says he has lodged an application with the Supreme Court seeking to overturn a High Court ruling that he relinquished authority over churchs Manicaland Diocese after he resigned about three years ago.

Jakazi is among a group of senior Anglican clergymen who include controversial former Harare Bishop Nolbert Kunonga who resigned from the Anglican church that they accused of condoning homosexuality. The senior bishops and their supporters have however refused to let go of church property despite ceasing to be members.

In a ruling handed down two weeks ago, Justice Chinembiri Bhunu said Jakazi lost his claim to authority over property belonging to the churchs Manicaland Diocese when he voluntarily resigned from the church in September 2007. But Jakazi says Bhunus ruling was wrong and wants it overturned to restore him as the leader of Anglicans and overseer of the churchs property in Manicaland.

“The appeal was filed on Friday, 21 May 2010,” Jakazi said, adding that by virtue of his appeal, Bhunus ruling stands suspended and he reverts to being bishop of Manicaland until the Supreme Court rules on the matter. He said: “I remain the legally enthroned bishop of the Diocese of Manicaland.”
