It is alleged that Kavinga was asked by the police to stop taking pictures of the demonstration, but continued doing so leading to his arrest and confiscation of his camera.
His lawyer Valentine Mutatu confirmed Kavingas arrest and detention saying that the police were contemplating charging him with practicing journalism without accreditation in terms of the repressive Access to Information and Protection of Privacy Act (AIPPA).

Flata Kavinga, a journalist with the Kwekwe based Midlands Observer was arrested and detained on 10 October 2010 around 1100 hrs while covering a demonstration by St Bernard Roman Catholic church members against the parishs priest.
