Vic Falls man sues Zesa

VICTORIA FALLS - A resident has instituted legal proceedings against the Zimbabwe Electricity Transmission and Distribution Company and three of its employees for compensation and damages for the sum of $1 950-00.

ZETDCO is being sued for not providing monthly bills and statements of accounts to the Plaintiff timeously and showing actual consumption, while the three employees are being sued for disconnecting electricity for three days with falsified information and documentation.

According to the summons – case number 133/11- filed at the Victoria Falls magistrates court, the Plaintiff, Peniel Chinoda of Mkhosana is citing a Mr Musaka (Zesa employee), T Chaita, (Zesa electrician), C Zinumwe, (Zesa acting credit controller) and ZE TDC as defendants.

The Plaintiff named above has instituted proceedings against you in your personal capacities an order for compensation and damages. You are hereby summoned that you do within seven days after the service of this summons upon you, enter or cause to be entered with the plaintiff at the address specified to answer the claim of plaintiff herein for the sum of $1950 -00 among yourselves and costs particulars whereof are endorsed. reads part of the summons.

On Tuesday 05 April 2011, 2nd defendant disconnected power transmission at the plaintiffs house to effect payment of an unknown outstanding bill. The defendants intention and purpose to disconnect plaintiffs power was malicious and the claim by the 2nd defendant to have been barred entry is false and damaging to plaintiff.

The court papers say Chinoda lost substantially both consumption and utilisation of electric power, personal and domestic use at the expense of falsified information and documentation by the defendants.
