Court rules in favour of Mazoe farmer

A Mazoe commercial farmer and his wife have been acquitted by a Harare magistrate court for allegedly occupying gazetted land without lawful authority.

The couple Adam Peter Richard Selby and Linda Selby and their company Komani Estates were brought before the court for allegedly occupying the land in Mazoe without lawful authority.

Harare magistrate Kudakwashe Jarabhini ruled that the arrangements by the late governor for Harare, Witness Mangwende, conferred rights on the couple as the lawful owners. He said the directive was still valid and nothing has changed.

Jarabhini ruled that there was overwhelming evidence that the couple was still lawfully authorized to occupy the farm.

He ruled that the land in dispute was not suitable for A1 or A2 farming models but had been designated for urban expansion and in the interim only peri-urban agriculture maybe permitted.

“A1 or A2 needs to be resettled somewhere not Komani Estates, it therefore follows the alleged offer letter to one JA Chanetsa is not describing the actual piece of land allegedly allocated to the beneficiary and or was issued in error because it is contrary to the

position or decisions of Minister of Special Affairs in the President’s Office responsible for Land Reform and Resettlement,” he said.

Jarabhini ruled that the documents by former governor Mangwende, which granted the Adams the permission to occupy and utilize Komani Estates, were not challenged by the state.
