
This time around the long overdue trial in case the two deny was deferred on the basis that the presiding magistrate, Mildred Matuvi is reportedly ill.
It is the state’s case led by prosecutor Bornwell Balamanje that in October last year, Chibaya and some MDC youths were coming from a rally in Mberengwa.
They allegedly stopped at a bar in Guinea Fowl , 15 Km from Gweru, where they got involved in a brawl with Zanu (PF) supporters.
But the MDC legislator, represented by Reginald Chidawanyika, is denying the charge saying he arrived at the shops and found Zanu (PF) youths stoning MDC youths which resulted in the damage of his official vehicle. The lawyer further states that Chibaya was only arrested when he went to Gweru Central police station to make a report.
It is not the first time Chibaya has had a brush with police. In January he was accused of assaulting a top army officer, Lovemore Hungwe. He was subsequently acquitted after the soldier disowned a police statement implicating him in the case.
