NRZ in court over non-payment

The Zimbabwe Electricity Transmission and Distribution Company has dragged the National Railways of Zimbabwe to court after the former defaulted on payment of electricity.

Court papers filed with the High Court show that NRZ Goods Avenue owes ZETDC Kwekwe District $384 144.87 for electricity consumed from January 2009 to April 2011.

According to the court papers, the two parties entered into an agreement through which ZETDC was to supply electricity to NRZ and the power utility company would bill the NRZ as per electricity consumed from January 2009 to April 2011.

However, ZETDC is alleging in the court papers that NRZ defaulted on payment and is now paying part payments towards extinguishing the debt.

The power utility company also alleges that NRZ is delaying on settling its debt in an attempt to frustrate them.

This, ZETDC claims, has led to the power company incurring unnecessary costs. ZETDC has also made demands in the court papers that they are entitled to costs on a higher scale due to the delay in payments. However, ZETDC, through its defense team of Mbidzo, Muchadehama and Makoni, disputed the amount being claimed by the NRZ, saying they did not understand how the figure of $384 144.87 was arrived at. The company is also disputing that the ZETDC is entitled to costs on a higher scale.
