Zim man to sue SA railway

A 25-year-old Zimbabwean man is suing the South African railways service for R1 million, following a train accident two years ago. Anele Nkomo was admitted to the intensive care unit of Pretoria’s Steve Biko Hospital for more than a month, and treated for a broken skull, broken ribs, neck and a damaged spinal code.

He is lucky to be alive. “Doctors say that I will gradually develop a brain problem as I continue to grow old and Metrorail must compensate me because it is their lack of customer safety that caused my mishap,” said Nkomo. “This case does need thorough investigations and careful handling, but it is one thing for certain that Nkomo must be compensated for the injuries he sustained,” said Attorney Nyaradzo Muzah, adding that the matter would cost betwenn R30 and 50,000 because of its complexity.

“The case needs a medical expert and a strong legal team of at least one advocate and an attorney,” she said.

The firm must consider pro bono assistance or other payment arrangements such as contingency fees, where the client does not pay for legal fees prior to the case but agrees that a percentage of the amount awarded by the court will be deducted by the firm afterwards.
