The top officer was convicted and sentenced to 12 months in prison for theft.
Kasu’s conviction came after he allegedly stole money recovered from thieves as exhibits to be put forward at the courts in February.
However, he applied for a high court order to set aside both conviction and sentence, citing innocence and the harshness of the sentence as his grounds.
Prosecutor Sifiso Ndlovu opposed the arguments saying he committed the offence while a leader of a police station, circumstances which put the name of the force into disrepute.
“The applicant undermined the interests of justice,” said the prosecutor.
However, Justice Mishack Cheda ruled that Kasu must be put out of custody on $100 bail pending judgement on his appeal. Kasu has already been fired from the police force.
