High Court postpones NCA referendum case to Monday

The case in which the National Constitutional Assembly is seeking to set aside the recently gazetted referendum dates has been postponed to Monday.

The matter was scheduled to be heard today before Judge President, Justice George Chiweshe.

The NCA was notified through a letter that Justice Chiweshe would not be able to attend to the matter as he was attending to “State duties”.

The Lovemore Madhuku chaired NCA on Tuesday filed an urgent chamber application at the High Court seeking to reverse the 16 March referendum date that was recently promulgated by President Robert Mugabe who invoked his powers under the Referendums Act.

The NCA is contesting the 16 March date which they say is too near and would not give Zimbabweans sufficient to analyse, study and appreciate the draft constitution in order to make informed decisions.

The NCA contends that people should be given at least two months to debate and analyse the draft constitution before the referendum is held.

In the urgent chamber application, the NCA cites Mugabe in his official capacity and the Acting Chairperson of the Zimbabwe Electoral Commission as respondents.

Alec Muchadehama of Mbidzo, Makoni and Muchadehama legal practitioners is representing the NCA.
