Allied Timbers boss dragged to court

Allied Timbers Zimbabwe boss, Joseph Kanyekanye (45), was last week hauled before the Mutare magistrate court to answer charges of unlawful entry.

Kanyekanye, who is also the Confederation of Zimbabwe Industries past President, was jointly charged with Killian Mandisodza and was represented by Johane Zviuya of Bere Brothers.

The two are facing charges of unlawful entry into premises as defined in section 131 of the Criminal Law Codification and Reform Act Chapter 9:23. They are alleged to have forcibly evicted Kingston Chikumbu who was employed as the Managing Director at EC Meikles Allied Timbers Muchena in Penhalonga without following proper procedures.

They pleaded not guilty to the charges.

The trial failed to kick off last week after the State did not produce the nexessary documents.

The State, led by prosecutor Tiriwamambo Kangai, heard that on June 20, 2012 Kanyekanye instructed Mandisodza through a Memorandum to use force and enter the house of complainant Kingston Chikumbu.

On June 25, 2012 Mandisodza teamed up with other Allied Timber workers and went to Chikumbu’s house where they demanded keys to the house from Estery Chakanyuka, the complainant’s housemaid.

The court heard that the maid rushed to call Chikumbu and Mandisodza demanded keys from the children. Mandisodza is reported to have threatened the children who ran away and sought refuge at a neigbour’s house.

Chikumbu later arrived and ordered Mandisodza to stop the eviction as he had no valid eviction order but the accused would not budge. He allegedly broke a glass door and gained entry, taking away property listed on ZRP form 162 to an unknown destination.

On June 26, 2012, Chikumbu filed papers against the eviction at the magistrate court. Mandisodza was asked to bring back the property.

Chikumbu later discovered that property worth $5,7 118.00 listed on the form was stolen and only property worth $35,920.00 was recovered. The matter will be heard today.
