
High Court Judge, Justice Joseph Musakwa, in postponing the case, said the State needed time to go through the application filed by the defence counsel.
Mtetwa’s lawyers launched an appeal with the High Court yesterday seeking to set aside the dismissal of her bail application by Magistrate Marehwanazvo Gofa on Wednesday.
The dismissal was on the grounds that the latter was likely to interfere with state investigations and cause commotion as she had allegedly done during her arrest on 17 March.
In their High Court application, Mtetwa’s lawyers, fronted by Harrison Nkomo and Dzimbahwe Chimbga, proposed that the top human rights lawyer should be granted bail on condition that she deposits $100 with the Clerk of Court at the Harare Magistrates Court and not interfere with state witnesses.
Mtetwa was arrested on Sunday 17 March 2013 and charged with contravening Section 184 (1) (g) of the Criminal Law (Codification and Reform) Act for allegedly defeating or obstructing the course of justice.
She is facing charges of trying to block police from conducting searches at the house of MDC-T official, Thabani Mpofu, after she argued that the police search warrant was illegal.
Meanwhile, the defence counsel for the four MDC-T officials being charged with contravening Section 4 (3) of the Official Secrets Act will today launch an appeal against the denial of bail for the quartet by the Harare Magistrates Court.
The four were denied bail on Wednesday on the grounds that they are facing serious charges and are a flight risk.
The four officers from the Prime Minister’s office, Thabani Mpofu, Felix Matsinde, Warship Dumba and Mehluli Tshuma were arrested on 17 March.
It is the State’s case that the four were found in possession of illegal documents some of which detailed the background of the Commissioner General of police, Augustine Chihuri, while others talked about Attorney General, Johannes Tomana.
Two general workers from the PM’s office were also arrested recently.
