Mtetwa had gone to inquire about the search warrant that was used to raid the MDC T offices.
However, High Court Justice Hungwe granted an order for Mtetwa's immediate release late last night. Nevertheless the state refused to comply with the order. According to Irene Petras the director of the Zimbabwe Lawyers for Human Rights (ZLHR) said: ‘Together with four other lawyers I attended Rhodesville police station at around 2.30am where police refused to comply with the court order. Law and Order personnel named in the application were made aware of the order too and similarly refused to cooperate around 3.30am. Efforts are continuing this morning’.

Defending Tsvangirai is fruitless attempt becaouse hw only need to be voted into power yet after winning with the constitution he influenced zimbabweans will not rule the country. If people are being persecuted now what if before, during and after elections and no one in MDC T is taking action then what will be the result?
My arrest and subsequent prosecution in 2003 was aimed at intimidating Judges and other people involved in the administration of justice. Beatrice’s arrest is well timed to send a message to lawyers who work day and night assisting people arrested by the police that they should stay away whenever the police are doing their duties. This is an assault on peoples rights to legal representation by those they choose to represent them. The rule of law is clearly under threat when those fighting for human rights are made to feel unsafe. I am really appalled. Coming at a time when the nation is holding a referendum this is not good for democracy.
