Election date case set for July 4

The case in which Justice Minister, Patrick Chinamasa, is seeking a two week extension of election date will be heard next week Thursday (4 July) before the Constitutional Court.

The case was postponed indefinitely yesterday after Chinamasa’s lawyer, Fred Gijima, said he needed sufficient time to respond to counter applications by Prime Minister, Morgan Tsvangirai and MDC President Welshman Ncube.

The two are contending that Chinamasa acted unilaterally in making his application before the Constitutional Court and should have consulted them hence their counter applications.

Tsvangirai’s lawyer, Advocate Lewis Uriri, told The Zimbabwean that the Chief Justice, Godfrey Chidyausiku said on Thursday that ruling on the matter could only be done after the expiry of the lifespan of Zimbabwe’s Seventh Parliament.

“We met with the Chief Justice today and he made it clear that we should not expect a judgement before the life of Parliament lapses.

“He told us he would prefer a situation whereby everything is properly in place and he has consolidated the applications by Morgan Tsvangirai, Welshman Ncube, the one by Nyikadzino and another one by Phiri and the case will be heard next Thursday with all papers having been filed on Tuesday,” said Uriri.

Nyikadzino made an application to the effect that the July 31 poll date declared by President Robert Mugabe did not give enough time to reforms necessary for the holding of free and fair elections while Phiri argues that she is being deprived of her right to vote as she is considered an alien.
