The ruling was made today in the Constitutional Court when the case was heard in chambers.
Nyikadzino this month approached the Constitutional Court protesting against a ruling in favour of one Jealousy Mawarire directing that elections be held by July 31.
On May 31 the Concourt ordered President Robert Mugabe to proclaim dates for elections, which the it said should be held not later than July 31.
The Constitutional Court ruling followed an application by Mawarire in which he was seeking an order compelling Mugabe to announce election dates at the expiry of Parliament’s seventh life.
However, Nyikadzino wants the Constitutional Court to declare that proclamation of an election date without implementation of media, security sector and other reforms is an infringement on his rights.
Part of Nyikadzino’s application reads: “As a human rights defender, I have been a victim of torture, harassment, arrests and so on. If the election is held before July 31 I feel I will not be able to exercise my right to vote freely.”
