Uhuru goes to court over report

Finance Minister Uhuru Kenyatta wants the High Court to quash a report by the Kenya National Commission on Human Rights linking him to post-election violence.

The report claims he participated or was involved in the violence by organising or funding gangs in Central Province.

Uhuru says the commission denied him the chance to defend himself
before compiling the report, On the Brink of Precipice: A Human Rights
Account of Kenya's Post-2007 Election Violence.

The Gatundu South MP is represented by lawyer Desterio Oyatsi.

On Friday, High Court Judge, Lady Justice Roselyn Wendoh, allowed the minister to file and serve the main suit within 14 days.

Uhuru argues KNCHR had no investigation jurisdiction to make an adverse finding against him without informing him.

He accuses the commission of being unreasonable and applying double
standards in the investigations because it gave other affected parties
the right and opportunity to be heard.

"The conduct of the said investigations was discriminatory and unfair," he argues.

He terms the decision malicious and aimed at giving his political competitors unfair advantage.

During the post-election violence that rocked the country soon after
President Kibaki was announced the winner of 2007 General Election,
hundreds of Kenyans were killed and thousands displaced.
