Botswana: Motswaledi moves to Court of Appeal today

botswana_motswalediBotswana Democratic Party (BDP) secretary general, Gomolemo Motswaledi plans to approach the Court of Appeal in Lobatse today in a bid to reverse a High Court decision dismissing his application for the suspension slapped on him by President Ian Khama.


Last Friday the Chief Justice Julian Nganunu, Justice Isaac Lesetedi and Justice Ian Kirby dismissed with costs Motswledi’s application citing Section 41 of the Constitution that protects a President from court proceedings.

Advocate Sidney Pilane confirmed to Mmegi yesterday that his clients have met and issued instructions that the decision of the High Court should be appealed. Pilane said they are busy finalising papers and they will file an appeal today.

Motswaledi will ask the Chief Justice to convene an urgent session of the court of appeal.

There has been a bit of uncertainty in the Motswaledi camp with some dejected members saying he should refrain from challenging his suspension and recall as a parliamentary candidate in Gaborone Central.

Others maintain that they are fighting for principle, and as such, they should go all the way. Those urging Mostwaledi to soldier on are said to be in the majority. They say Motswaledi has nothing to lose, especially that he has been rebuffed by a party faction that is vindictive and is bent on singling him out and humiliating him.
