Police should issue original court summons: Mandebele

A human rights lawyer has challenged police to issue genuine court summons recognized by other courts of law.

Makiyasi Mandebele is representing two MDC-T security officers who were allegedly assaulted by Zanu (PF) thugs but were accused by police.

He recently threatened to stage a one man demonstration against police if accused Zanu (PF) perpetrators of violence were not arrested. Last Tuesday he successfully applied for his clients to be removed from bail until proper court summons were issued by police.

Police had issued the accused with an informal summons not written on proper stationery, because they said they did not have the proper forms.

“I do hereby challenge the validity of the ‘summons’ issued against my clients by police. The summons should be proper and worth the attention of the High Court and other superior courts of law. In this regard, I apply for this respected court to remove my clients from remand,” said Mandebele.

The application was granted and the trial suspended. Police were instructed to proceed with the case by way of summons.

According to the defence, MDC-T party security officers, Wellington Makonese and Kenneth Jack, were assaulted by Zanu (PF) youths led by Chengetai Bwanali, at the Murewa-Dombotombo road turn off in May. The assailants also allegedly attempted to run over the MDC cadres with a vehicle.

The MDC security officers proceeded to make a police report at Dombotombo Police Station. The following day, the Zanu (PF) youths went on to make a counter police report at the Police Station. Police reportedly dismissed the MDC report resulting in the arrest of Makonese and Jack. The two were detained for three days in police cells before they were released on $40 bail each on June 15.
