MDC Renewal Team Concourt hearing today

The Constitutional Court will at noon today sit to decide if the application by 21 MDC Renewal MPs who were recently expelled from parliament must be heard on an urgent basis.

Chief justice Godfrey Chidyausiku will hear the matter in chambers.

The MPs want the case to be set down as an urgent matter and to be finalised before the April 16, the nomination date in relation to the holding of by-elections for the now vacant seats.

The 21 MPs were expelled after MDC-T approached parliament seeking for their seats to be declared vacant since they had allegedly joined a new formation, the United MDC.

UMDC brought together a splinter led by Welshman Ncube and the Renewal Team, but the latter are arguing that the united front is not a political party yet.

Chris Mhike is expected to lead the applicants’ legal team while Tendai Biti, the Renewal Team secretary general, will also attend.

Of the 21, 17 are from the national assembly and four from senate.

MDC-T is guaranteed of seven of the seats since they were allocated on a proportional representation basis and must be retained by the benefiting party.

Sekai Holland who leads the Renewal Team confirmed an email message that the matter would be heard today.

“Our SG (secretary general) Tendai Biti and Chris Mhike will be present to put our case to him (Chidyausiku) so that appropriate dates are set, necessary follow ups are done to beat the deadline. The date for the hearing must be set for our case before 16th April; the nomination date for our seats,” said Holland.

The 21 legislators insist that there was no proof that they are no longer with MDC-T, in addition to the fact that the courts are yet to decide who, between them and the Morgan Tsvangirai led formation are the legitimate MDC-T.
