Concourt dismisses Mutasa, Mliswa application

Expelled Zanu (PF) Secretary for Administration, Didymus Mutasa and former Hurungwe West Member of Parliament, Temba Mliswa had their Constitutional Court application challenging their dismissal from Parliament dismissed with costs today.

The move means that the by-elections for Headlands, where Mutasa was Member for Parliament and Hurungwe West will go ahead on June 10 as previously scheduled.

The seats fell vacant after the Speaker of Parliament; Jacob Mudenda ruled that the two were no longer fit to represent the two constituencies after they had been expelled from Zanu (PF).

The Constitutional Court ruled that the application by Mutasa and Mliswa lacked merit.

Chief Justice, Godfery Chidyausiku, said reasons for the judgement will follow in due course.

Mutasa and Mliswa were dismissed from Zanu (PF) for continuous undermining of the party’s leadership.

The two were arguing that due process was not followed when they were dismissed from Zanu (PF) hence Mudenda had no authority to declare their parliamentary seats vacant.

Mudenda, President Robert Mugabe and the Zimbabwe Electoral Commission Chairperson, Rita Makarau were cited as respondents in the application by the two former legislators.

Mudenda argued that the ejection of Mutasa and Mliswa from Parliament was done above board.
