High Court dismisses journalist application

High Court judge Justice Priscilla Chigumba has dismissed the urgent chamber application by freelance journalist Tony Manyangadze seeking an order for the release of his camera allegedly confiscated by the police.

courtIn her ruling, Justice Chigumba said she  could not issue the order because the police deny knowledge  of or possession of the camera in question. She also noted that Manyangadze had not been able to identify the officer who allegedly confiscated his camera making it difficult for her to issue an enforceable order.

Due to the arising dispute on the whereabouts of the camera, the judge said that the matter could not be resolved on the basis of the papers filed without hearing evidence on the matter.

Justice Chigumba had given the Zimbabwe Republic  Police (ZRP) until 19 August 2016 to locate or make a sworn statement on the whereabouts of a camera belonging to Manyangadze which was confiscated by one of its members.

This followed an urgent chamber application filed by Manyangadze on 11 August 2016 seeking an order compelling the police to return his camera.
